Laws and Regulatory Framework

All governance in Mohéli operates under a system of laws and regulations designed to ensure order, justice, and development. While Comoros’ national laws apply throughout the Union (including Mohéli), the autonomous island also has the ability to enact local regulations in certain domains. Our Laws & Regulations section provides a searchable database of legal instruments relevant to Mohéli. Users can find Union Laws (lois de l’Union) such as the Comorian Civil Code, criminal law, commercial law, and sectoral laws (for example, the Education Act or Fisheries Act) which have nationwide effect. In addition, we include Ordinances and Acts of the Island of Mohéli – these are laws or by-laws passed by the Mohéli Island Council or decrees issued by the Governor on matters within Mohéli’s jurisdiction (like a local environmental protection regulation or a market zoning law).

The database is updated to reflect new legislation, including any updates from the Union Assembly that impact island governance (for instance, changes in decentralization law or finance law that affect Mohéli’s budget). Key legal documents available include the Constitution of the Union of Comoros and the Fundamental Law of Mohéli (2002) as foundational references. We also provide regulations for business and investment on Mohéli, such as the Investment Code which outlines incentives and rules for investors, and the Mwali International Business Companies Act if you plan to register an offshore company via Mohéli’s international registry. For citizens, we list laws pertaining to land and property, family law (marriage, inheritance – noting that customary and Islamic law practices are acknowledged within the legal framework), and labor law (worker rights, minimum wage, etc.).

The judicial framework is also outlined: while serious judicial matters are handled by Union courts (the Court of First Instance in Mohéli and appeals to the Union Supreme Court), minor disputes can be settled in community courts with respect to local customs . Moreover, regulations from various ministries (often called Ministerial Decrees or Arrêtés) that implement laws – such as public health guidelines, school curriculum standards, or transportation safety rules – are accessible here for reference. By compiling these laws and regulations in one place, we aim to educate citizens about their rights and obligations. Should anyone require clarification of the laws, the Ministry of Justice and Legal Affairs (see Cabinet Section) provides legal aid and can guide the public on navigating the legal system. Ultimately, a well-informed public is essential for the rule of law, and Mohéli’s government strives to make the legal framework as transparent and understandable as possible
